New York City Home Depot Vehicle Booting Fees Class Action Settlement
If you've ever had your car booted at a Home Depot in New York City and had to shell out more than $25 to B & M Towing Inc., B & M Electronic Diagnostic Repair Service Inc., or NY Booting to free your vehicle, this blog post is for you.
A class-action lawsuit claims that these towing companies violated New York City law by overcharging customers to remove vehicle boots at certain Home Depot locations during 2021 and 2022. B&M Towing, a New York-based company, has been especially highlighted, with numerous complaints regarding their vehicle towing and booting policies appearing on their Better Business Bureau profile.
In response to these allegations, the New York City Department of Consumer and Worker Protection (DCWP) is administering a settlement to resolve the matter. Under the terms of this settlement, consumers who were overcharged for booting their vehicles can receive a refund for the booting fees they paid over $25. Refunds will be distributed on a first-come, first-served basis, and once the settlement fund has been exhausted, no further refunds will be issued.
It's important to note that there is no exclusion or objection deadline for the vehicle booting settlement, and no final approval hearing date has been listed on the settlement website. However, consumers must submit a valid claim form by July 19, 2023, to be eligible for a settlement payment.
